Primetime Charters 361 – Cancellation & Refund Policy

Your purchase does not guarantee a reservation until confirmed by Primetime Charters 361. We reserve the right to cancel or reschedule any trip due to unsafe conditions or unforeseen circumstances.

If a charter cannot be performed due to weather (lightning, heavy rain, fog, high winds) or mechanical issues, customers will receive the option to reschedule or receive a full refund.

We prioritize the safety of our guests and crew at all times.

 

What CAN Be Refunded

Weather-Related Cancellations:

Trips canceled due to unsafe weather conditions will be refunded 100% or rescheduled based on customer preference and availability.

 

Mechanical Issues:

If a trip must be canceled due to boat maintenance or mechanical failure, customers will be given the option to reschedule or receive a full refund.

What CANNOT Be Refunded

​

• No refunds will be issued for unused portions of a trip after departure, regardless of reason (including early return).

• No refunds will be issued for cancellations made within 72 hours of the scheduled trip.

• If cancellation occurs within 72 hours, the full remaining balance of the charter will be charged.

 

Rescheduling Policy

​

• Trips may be rescheduled at no cost if requested more than 72 hours in advance, based on availability.

• Weather-related reschedules will always be accommodated at no additional charge.

 

Additional Terms

​

• All cancellation and refund requests must be submitted in writing (text or email).

• Refunds will be processed back to the original form of payment.

• By booking with Primetime Charters 361, you agree to this policy.

1. ACKNOWLEDGMENT OF RISK
I, the undersigned participant, understand that recreational fishing and boating activities involve inherent risks,
including but not limited to:
• Slips and falls on wet surfaces
• Hooks, knives, gaffs, and other sharp equipment
• Marine wildlife injuries
• Rough seas and unexpected weather conditions
• Equipment failure
• Vessel movement, including sudden stops or impact with waves
• Boarding and disembarking hazards
• Drowning or serious bodily injury
I voluntarily assume all risks associated with participation in this fishing charter.

2. RELEASE OF LIABILITY
In consideration for being permitted to participate in this fishing charter, I hereby release, waive, discharge, and
covenant not to sue PrimeTime South Texas Group, LLC, its owners, members, managers, employees, crew, agents,
and affiliates from any and all claims, demands, damages, causes of action, or liability arising out of or related to any
injury, illness, property damage, or death that may occur during or as a result of participation in this fishing charter,
whether caused by negligence or otherwise, to the fullest extent permitted by law.
3. MEDICAL AUTHORIZATION
I certify that I am physically able to participate in fishing and boating activities. In the event of an emergency, I
authorize the captain or crew to obtain medical treatment on my behalf. I understand that I am responsible for any
medical expenses incurred.

4. SAFETY AGREEMENT

• Follow all safety instructions given by the captain or crew
• Wear safety equipment when instructed
• Refrain from unsafe or reckless behavior

6. PHOTO & MEDIA RELEASE

7. GOVERNING LAW
This agreement shall be governed by the laws of the State of Texas.
8. SEVERABILITY
If any portion of this agreement is found unenforceable, the remainder shall remain in full force and effect.
